[Solved] CSA / Maintenance : Pension Contributions

Hi,

Just a quick question - I am aware that there is a ceiling on pension contributions taken into consideration with regard to any maintenance agreement.

I am 47 and am allowed approx. 20% pension allowance.....

The issue is : is this 20% of my gross salary or 20% of net salary after NI and TAX deductions.

All calculators and guidance indicates the pension contribution it deducted from the GROSS, but there is no guidance on where the calculation on maximum is benchmarked from.

Any help or comments greatly appreciated!

Is there a difference in the case of pension as you are given tax and NI relief on pension payments aren't you?

Hi,

The value you can have as a maximum payment is based on a % of either net or gross.....but the CSA don't have any documentation to establish this.

The NI and tax relief is irrelevant at that level.

There is nothing in the public domain......but it is the CSA...so am I surprised???

In which case, it may be worth speaking to the CSA and trying to get something in writing from them. - the CSA guide on payments has a number to query about pensions - 0845 266 8792, so that might be a good place to start.

I have tried, but no one can answer the question.....

Even spoke to complex case worker...no idea on the % guides or how calculated..

Seems I have hit a dead end!

In which case, how about writing to them stating that you intend to pay contributions of £x (using whichever figure is most advantageous to you) under their guildelines (and quote them) and can they confirm in writing in 14 days that this is acceptable. Keep a copy, send it recorded and keep the postal receipt with your copy. Basically, you are doing as much as possible to cover yourself if they try and argue later on.
