Hi need a little advice my son is 17 and living with the ex, he started collage in September but only went a couple of weeks and has since quit.

She has not told the CSA this or child benefit, csa have tried to contact her and she has ignored them, but CSA say that they can not do anything if she is claiming child benefit, and yes i have called child benefit, but told it could take months.

Can i do anything else.

If this happens when my child quits college, I won't be paying, I will refuse to pay CSA and write to my MP

Why should you pay maintenance if its not due! And then maybe never get any over payment back

But the problem is that if you cancel the payment they will just arrange to take it out of your wage. can not win. and i cant see me getting any money back.

Did you now though its illegal for your employer to deduct anything from your wages without your permission

How friendly are you with your boss

Write to your MP, there are hundreds of people in the same boat, PWC's claiming CB when they shouldn't be, he may be able to speed things up for you

I will give it ago and send him an email, anything is worth a try. I just find it strange that they can let this happen, The first call i made to them was in October and was told that she will have to tell them. And absolutely nothing i can do. Oh yeah as if she is gonna ring up to stop it.

Mrk,

I was in the exact same position as you, my daughter left fulltime ed last August and is in Spain and has been since October 13, my ex still claims CB and the CSA kept saying if CB is in payment then so should CSA......even though she is claiming CB fraudulently?
After 7 months of twice or three times a week with the CSA, I'd had enough, I wrote to my MP and had a reply , then wrote again and finally it is sorted, although I still think my ex is still claiming CB!

WRITE to your MP!!!!

The new CMS system will not say "you are liable to pay CSA if CB is in payment" anymore.
