I've paid child maintenance for 12 years for my 2 children. Ex and I came to a private agreement based on CSA calculations.
My payments reduced significantly after being made redundant a year ago. She opened a case with Child maintenance and after much form filling, it was agreed that I paid a lesser monthly amount, including a percentage of my redundancy lump sum payment.
I have not missed a payment since we split up.
The letter received today states that I owe £700. I phone the CSA and was told to wait to receive a statement.
The arrears date back to 2010. There was no case with the CSA back then and when she opened a case last year it was deemed that I owed nothing in arrears at that point.
Very confused. How can they backdate it if they were not involved until last year?
...during tonight's phone call they quoted £500!
Any ideas please?
Thanks 🙁
I have had this with the csa before and not really had that much problem,,,, yes csa debt can mount up until you prove you do not get the income.. you have to prove you only receive this money as when the debts where first noticed......eg job one day....... dole the next..... Jsa is 5.00 per week,, no money no CSA
Just be nice to the CSA they know a man has to work
Can the CSA demand arrears for a time period in which payments were made by private agreement? As far as I was concerned all payments were made, even when made redundant. I used redundancy money until I got a lower paid job (when CSA got involved...EX not happy with lower amount at that point and contacted them ).
I'M always nice 🙂
They can disregard payments privately and claim it wasn't for child maintenance, but for other things unless you have any evidence (eg a standing order stating child maintenance). What they can't do is backdate to before the case with them was opened, so I assume your ex must have opened a case with them back then. I would ask for a breakdown of the arrears, and put up an argument that you have paid by private agreement.
I've got personal agreement paperwork drawn up by solicitor when sorting pensions, and evidence through bank statements... somewhere.
Just waiting on breakdown of costs from CSA. Thanks for replies.
She took our children to Cyprus and prevents me from seeing them.
