[Solved] CSA arrears

Hi. I have been sent to lots of arrears claims from the CSA via the CMS.
The 1st is for £4k dating back to 1994. This case was clised in 2014 and last year I was told I owe this 4K as my ex was on benefits between 1994-2008.
They have this wrong as I was still with my ex until 1995 and she has admitted she was only on benefits between 1995-1999. I also paid her direct which she has agreed.
The CMS will not accept anything I tell them. They just keep asking for Bank statements to prove I paid.
I keep telling them this Bank account was closed in 2000 but,still I get no where.
The debt arrears don't work out as the CSA have taken random months in a year up too 2008.

The 2nd case the CSA are claiming I owe artears between 2008-2009. I have shown proof of a letter addressed to my MP from the senior resolution manager of the CSA that I have no arrears for the months claimed and yet the CMS have said I do owe this as it was a computer error.
I was also told after I rang the CMS in Dec 2017 my case was being closed from Sept 2017 as my child is in further education and attending a college. They also sent this to my MP.
So I stopped paying in Dec which they agreed I had overpaid by 3 months
Now I have received a Collect and Pay demand for not paying maintenance for Jan,Feb,March 2018.
I rang them to ask about it and the CMS have just said they made a mistake and the case shouldn't have been closed.
I have tried to talk and get proof from the CMS but they will not offer anything and just say I owe the arrears and tough.
Has anyone and advice how to sort this please?

If they're not listening to you, I would go and see your MP and ask for them to help you. Ask them for a breakdown of the arrears in full and in writing and ask them to communicate in writing in future, this way you have a written record of what's being said.

You can also open an appeal directly with them and also they have a complaints procedure.

Hi Mojo.
I have asked for a breakdown but, this has been refused.
My MP has been involved and he has not done much to be fair.
I have logged 5 or 6 complaints but never get a response.
Their attitude is we have been sent the arrears from the CSA and we have to collect the money.
I even rang the CSA for advice but, they couldn't help as my case is clerical and the CMS have it now.

I didn't think they could refuse to give you a written breakdown! Have you used the official complaints procedure to log your complaint? Sorry to hear that your MP isn't doing much, you're just going to have to push him to do more.

Definitely push your MP, and tell him you have been refused a breakdown. I wasn't aware they could refuse - I can't see how that can be legal. I would put it in writing to them that you have been refused a breakdown and that you insist on having one - send it to them recorded, and keep a copy of that letter and your tracking receipt (and print off proof of delivery when it arrives) - I think it could prove useful in the future if it went to court proceedings.
