[Solved] CSA Arrears

Hi All

Looking for advice. I left UK in 2008 with a Deductions Order in place on my then salary. My children are now in 20's.

If I return to UK to work now will that Deductions Order still appear ? Will CSA or its successor still chase me for arrears ?

A Deduction Order is sent from the CSA/CMS to the Employer - its not part of the HMRC Paye system - so in that sense it should not "follow" you.

However obviously the order itself could still be live and applicable - though not sure if it would need to be "refreshed" to a new one - very possibly.

The CSA cases are in the process of all being closed, with some transferred to the CMS for active cases. That transfer process started a couple of years ago - so I guess it depends on the exact ages of your children if your case made it to CMS as an active case.

The receiving parent is normally written asking if they want to continue to pursue the money or write it off.

So potentially yes they would have the right legally ( and to be quite frank morally ) to pursue the money still.

Depending on what country you left to they could of pursued it anyway, depending on if there is a Child Maintenance agreement between the two countries.

As far as I know, if there are arrears, then they remain until they are paid off or the other parent says they don't want to chase, as David says above. The CMS potentially will try to get the debt repaid as soon as possible, I think that means potentially up to 40% of your income.

They will chase you AS SOON as they know you are back in the country.
The deduction order is just one way of trying to ensure you pay what the deem that you owe.

The money is still owed.
These days they have all sorts of other additional statutory powers, such as even applying to the courts to withhold you passport and/or driving license if you are deemed a flight risk.
