Hello I have two csa cases set up one mother wants to do a family based arrangement and come off csa other doesn't. Csa advised me having a arrangement reduces the amount the other parent receives and they don't get thr full csa claim ect is this true how does it work as pretty unsure of it
If you have two children living in different households, I think the CMS will make the calculation for two children and then the final amount will be divided between both.
For instance, for two children they would make a reduction of 16% of your gross income (before tax) . Let's say you earn £400 pw before tax, 16% of that would work out at £64, divide that by two and each parent would receive £32.
The calculation for one child is 12% of gross income, which would work out at £48 so before the second child was factored in, the first mother would have received £48, once the second child is factored in her payment would be reduced to £32.
That's a basic calculation, it can change if you have one child overnight and not the other.
This probably explains it better!
Hello Lostinblac
Based on what you have written, it sounds as though your child maintenance is currently managed by the Child Support Agency (CSA) and they do not take any payments you make through a family-based arrangement into account.
However, as Mojo has explained, when there is a case in place with the Child Maintenance Service (the government’s new statutory service), any payments you were to make through a family-based arrangement would be taken into account when calculating the statutory child maintenance amount. You can find more information about how the Child Maintenance Service work out child maintenance payments via the link supplied in Mojo’s post.
For more information on all the different ways to set up child maintenance and for a more personalised service, you can visit the Child Maintenance Options website at http://www.cmoptions.org.
The DWP have a sorting out separation website that you may find useful. It offers help and support to separating and separated families. The link is: https://www.sortingoutseparation.org.uk/.
