Hi everyone 👋

I am looking for advice. I have a 12 year old son with my ex (never married) and I am in a long term relationship with current partner (7 years now); up until recently, I have been having regular contact with my son who spends 2-3 nights a week at my house. My current partner works, I do not because of ill mental health and an ASD diagnosis. I do however get ESA on top of the joint UC claim. My ex has decided to get a CSA claim going despite the fact I do pay money into her account for things my son needs, also school trips, phone top ups, clothing etc (and I've got bank statements to prove it). My ex seems to think that because my partner works, she will be entitled to money. I'm not sure this is correct. I did a CSA calculation and it states that I don't owe anything, although I would never not pay for my child. I do everything and give money to my ex for him.Β  Is it correct that my ex can claim money from my current partner's income?

Hi,

Your partner working or getting UC has no effect on your child maintenance case. It is all based on paying parents income. CMS will probably send your ex a letter telling her she is entitled to Β£7 a week because your on benefits.
