[Solved] CSA AND CHILD TAX

hi, i have lost my job and don't have enough stamps to claim jsa, my wife works 24 hours a week and has a 16 year old daughter that lives with us and is in full time education, i have no income at all but my wife gets a wage and working tax and child tax for her daughter, the csa have told me that even though i have no income at all my wife has to pay £5 a week from her child tax for my child to a previous relationship, so in fact my step daughter has to pay for my child, is this right please

Hi

I believe that is correct unfortunately - you wife's income is not included, but child tax credits are.

Hi Sher52

Thank you for your post. I am William the Child Maintenance Options consultant. When the Child Support Agency (CSA) calculates maintenance, they also take in to account any Child/Working Tax Credits that you, or your wife, may receive. This is because it is classed as a household income.

The only time Working Tax Credits would not be taken into account is if your wife is the main earner in your household. However, Child Tax Credits are always taken into account.

You may wish to contact the HM Revenues and Customs via the following link: www.taxcredits.inlandrevenue.gov.uk to inform them that you are no longer working as this may have an effect on what your wife receives.

With you having a case with the CSA you may wish to speak to them directly to discuss your concern. Their contact details can be found on any letter they have sent you, or this website https://www2.dwp.gov.uk/csa/v2/en/setup/apply-by-telephone.asp provides their contact details.
