I have two girls, 12 and 15, my youngest has come to live with me and now i am trying to gain child benefit and CSA payments but child benefit are saying it take upto 12 weeks for the process to complete and the CSA are saying that they cannot alter my payments (only pay for 1 child) until i have my child benefit in place, so i am having to pay their mother the full amount of £360 a month until this is resolved, surely this cant be allowed, everytime i ring the CSA they just fob me off, can anyone help??????

IM know expert at all, but have just started having to deal with all of this nonsense. From my understanding, Im afraid I think you a stuck. Its damb unfair and I really feel for you. At least you will be getting something back in the future and most importantly you will have one of your kids with you now. Good luck!

I think you are generally stuck with the situation. The CSA are fairly ruthless with pursuing people who don't pay, so there is a risk in not paying - if you stopped paying (but paid the money into a savings account so you have it in case it goes against you), and wrote to the CSA (send by registered post so you have proof) stating why you are stopping paying, and in fact you want to raise a claim against your ex for maintenance that she owes you, you may get away with stopping your payments, and could certainly justify your actions if they take you to court for the arrears.
