[Solved] CSA

Hi All

just signed upto this site as i received a letter from the Csa saying my payments have finished Case closed.... and the next letter a week later says they owe ME £156 and 2 months later still not received any money so when i call them they say sorry our mistake you still need to pay???? this is after them telling me for the last 2 years that it stops in September 2016. where do i go from here any advice please.....

It depends upon the reasons why it was closed in first place and then reopened (which you have not stated - nor the ages of any children to which the case pertains).

I suspect - it could be the child(ren) in question are college/uni age - and at one point the child was not going to stay in full time education (so CSA/CMS stops at 16 years) age). Perhaps the other parent was late in informing the CMS the "child" will continue in full-time education - and in this case CM stops at 20 years of age. September is the start of the academic year for most places - this is why it made me think of that.

Could that be why? If so, (and you have no reason to suspect it is a fraudulent claim on behalf of the other parent) there is nothing to do about it but continue to pay CM. Here is some info https://www.gov.uk/when-child-maintenance-payments-stop

If you suspect it is a false claim - you would first need to report "child benefit fraud" first

as the CMS will most likely say that their records show other parent is still in receipt of child benefit as the child is still in full-time education. After that - contact CMS to say that you have reported the fraud - and want a revaluation. This will take *some time* no doubt. If you go down this path - be aware the "other parent" may "ask" the child to sign up for a college course...and you will need to be on the CMS's case checking that they are carrying out the revaluation.

Hi,
And thanks for the reply my son was 19 in November and is at college for 12 hours a week and they class this as full time for some reason, and his mum is still claiming CM so that’s why I must pay CSA I have been through the fraudulent claim before as my son dropped out of college and was working I was told they have a cooling off period for 12 weeks so I left it for that time and he was still working I reported her so many times its untrue. Then 4 months after that he went back to college so I lost that battle again, and she got away with it, I was only checking if there was something I could do or someone else have been through the same thing to escape being shafted for another 12 months or so. They build your hopes up saying the case has ended and they owe me all by letter then tell me over the phone that it is not! and I still have not received anything in the post yet. So it looks like that I will have to put off clearing my debts for another 12 months now.
