So last week I lost a hearing and the court took away a Wednesday Onight stay - so I went from an average of 2 nights per week to 1.5 - On top of that I got 4 weeks of holidays - I get some availability in the other holidays but even then Im just 4 nights short per year of getting to the 104 I had before
Im appealing the court order as I want more time but the new order is going to push my payments up another £70 a month and I really cant afford it - CSA and ex arent interested - pay it is all im getting - and CSA are saying nothing they can do they dont deal in decimals - you fall into one bracket or another
Is there absolutly nothing at all I can do here ? Im absolutly fudged
Do you incur any costs for travel that might make you eligible for a Variation Order?
I do yes but they say im on another discount scheme because i have them overnight
Have you confirmed this with CSA/CMS?
I asked them about the variance when they moved last month they said you cant have the travel variance if you have them on a shared residency thingy
That's odd as my friend has his kids alternate weekends but qualifies for a variation..... Sorry not to be of more help 🙁
Thank you for your help - CSA/CMS never have to make sense - they are a lawunto theirselves
Last time I dealt with them they took an extra 70 out of my account as I started a DD - I took that straight back through a BACS recall - the delay in payments to the ex meant she agreed to direct pay again but when I rang them up citing THEIR error they wouldnt give me a refund or fix it
