Hi
I’m a single mum and last year my daughter decided to go and live with her dad who has recently gone via CMS for monthly maintenance payments
when we got divorced we didn’t get a financial order to cover the child but have recently got an order made covering the transfer of the property to my name
on the order is says
except as provided in this order the parties claims for secured periodical payment orders lump sum orders, property adjustment orders shall be dismissed and they shall not be entitled to make any further application in relation to the marriage for an order under the matrimonial causes act 1973 section 23 1- and 1b
my question is does this include child maintenance as he earns significant more money than me
thanks for any input
hi,
going by the wording in the order, this has no relation to child maintenance claims.
child maintenance falls under Child Support Act 1991, as well as Child Maintenance and Other Payments Act 2008. so Either parent is entitled to apply for child maintenance, depending on who is primary carer and number of overnights/shared care etc.
@bill337 thank you
i appreciate your time in responding
