[Solved] concerns with the new CSA

Hi

Ive found out the my case with the CSA is being closed on the 26th of this month, however the case is being picke dup by a new governing body. I have had no correspondence from the new body and I have my concerns during this transitional period.

Has anyone else already been through this and how did you approach it?

They will be transferring you over to the new system, which calculates the amount you pay as a percentage of gross income. It might be a good idea to use the CMS calculator to see what the difference will mean for you. Here's a link

Hello captainkirrane

Now that your Child Support Agency (CSA) case is closing, that means that you and the other parent need to arrange an alternative agreement.

This can mean using the Government’s current statutory scheme run by the Child Maintenance Service or if you are able to speak together about financial matters, you are free to set up your own family-based arrangement.

The family-based arrangement is an agreement between parents without the involvement of the Government or legal system so it is more flexible than the statutory arrangement and can include other non-monetary contributions such as; buying clothes, paying for trips or childcare.

On the Child Maintenance Options website, http://www,cmoptions.org, you will find lots of tools and guides which are designed to help parents wishing to set up a family-based arrangement. These include the Discussion guide, the Family-based arrangement form and the Online calculator.

Your CSA case, apart from any arrears, will not automatically transfer over to the Child Maintenance Service. One of the parents would have to apply for a case with them. There is a £20 fee when the application is made. The Child Maintenance Service can either calculate what is to be paid and then leave it up to the parents to decide when and how the payments are made which is called Direct Pay or they can manage the arrangement entirely which is called Collect and Pay. There are further charges involved with that arrangement.

The other option available is to go through the courts and set up a Consent order/Minute of agreement.
