Well the CMS have reached an all time low intimidation because ive requested a hearing !!!!! I ve recived a call today of which I can only describe as bully tactics telling me they are not going to change their decision and they are going to come to the tribrunal . Why ring me ? Why not submit your evidence to the tribrunal in the specified time oh ,!!! That's passed and your late . Another complaint lodged , letter goin to tribrunal requesting them to reject the evidence from the CMS they've had long enough !!!

Just out of curiousity what are you doing about your payments at the moment? Are you paying based on what they calculated including the Company Car Tax?

I'm paying the schedule as I've been threatened that if I don't pay that they will apply to have it deducted from my salary . They are such a loverly organisation to deal with
I was asked to forward a letter stating total income and my benefits in a letter from HMRC and amazingly they stated this should be reviewed favorably towards me, seemed very hopeful at this stage! I received a letter from HMRC and submitted it, I have now been told to request a mandatory review, which they suspect will fail, I assume I will have to go to tribunal after that?

I'm still awaiting a tribrunal date the CMS have confirmed that as company cars are an income of kind then the Notional value for tax reasons is classed and will be treated by them as income. The CMS have reviewed my case again (third time ) and still no change so, tribrunal it is. There are a lot of areas with this process that I and many people don't feel is fare for us the NRP's and paying out something for something you don't receive is really grating me especially as it's the use of tax twice.
Dear all today I had my day at tribrunal and I'm sorry to say I lost on the grounds of section 36 of the CMS 2012 scheme . Basically anything that you have which adjusts you Beniefit code the RP is allowed to have a % of that Beniefit a out as its classed as income . That is totally inappropriate and is a very dangerous legislation for company car drivers as you will be spanked twice for a company car !!!!!
