The CMS and its calculations are totally flawed. It makes no logical sense, a few pointers;
Child Maintenance is to be paid until the child is 20 if in full time education. When does a child become an adult? .... I'm sure in other government laws it's 18..... so how come the CMS gets away with age 20?
Full time education is 12 hours or more per week. Full time work is 37 hours.... so how come education is classed at 12 hours?
I have two children from a previous marriage, the eldest is leaving school and works approx 16 hours per week minimum and will be studying 12 - 16 hours per week at a college studying a btec. The ex has remarried and both have reasonable jobs, nice lifestyle etc....... I pay an obscene amount per month.... in my opinion the ex should be means tested and this have a bearing in payments.
When eventually my eldest does not qualify for me paying child maintenance, the amount is not halved, but reduced by 20%....... another totally ridiculous calculation.
I have a 4 year old child currently living with me which reduces my maintenance by 2% ....... this is now becoming unbelievable.
Due to work and new family commitments I live 150 miles from my children, I cannot afford to pay the maintenance set in addition to the travel costs to perform 2 x round trips to collect my children (600 miles), so since the CMS became involved I no longer see my children regularly. They did say I could claim travel expenses, but needed proof of the expenses, on giving them petrol recreipts they were not sufficient. They know where I live from HMRC, yet will not accept the 150 mile trip qualifies as travel expenses to collect the children.
I would like to know who is responsible in the government, what political party is fighting to change this stupid unfair and unjust government organisation. Also if there are any petitions in place, if not I will start one.
