CMS referral despite private arrangement

I've been referred to CMS despite having a private agreement in place with my ex. 

She was an abusive partner and has done this purely to further exert control and abuse over me. 

Can I not give evidence to CMS that I was already paying the recommended amount and there's no need for them to facilitate her abusive behaviour.

Sorry to read this Tom. I have also been a coercively controlled party in the games. I also have been paying my ex via a private arrangement utilising the CMS calculator. However at the start of October - contact was refused with my 4 lads and then have the joy of CMS now getting their claws in. The summary is CMS don’t care about anything you’ve done prior to the case opening. I’m about 3 weeks into my CMS journey and trying to fight for clarity on calculations etc. many threads on this here. I wish you good luck in your journey. Just wanted to specifically reply to you as there are lots of dads out here that are all suffering the same issues with our ex’s.

Hi,

You could tell them you have a private arrangement thats working well. But they will likely disegard it and expect you to pay through them. Make sure they put you on direct pay.

Hi tom353, it's a real shame that some parents continue to be controlling and vindictive. To build on what Bill said, the Child Maintenance Service (CMS) will not take into account that you have a voluntary arrangement in place. The only way the direction of travel will change is if the applicant - i.e., your ex - withdraws her application / requests to close the case. The CMS will now liaise with HMRC and base their calculation on the 2023/24 tax year and each tax year thereafter unless your income increases by 25% within the current tax year, which you are liable to report to the CMS. There is a plethora of information on dad.info to answer most of your questions, including when CMS payments cease.
