Hi,
A question in relation to child maintainance. Currently child arrangement order in place 2 nights every other week and then extra 8 nights during holidays.
My question is, do CMS take into consideration any reduction in nights due to COVID isolation reasons and being unable to have the children the court ordered nights? Would they want to increase payments for paying parent even if they have offered to swap weekends and other parent won't swap.

I remember at the peak of the lockdowns, CMS put a note on their site which stated that if a child is not seeing a parent due to covid lockdowns, this is only a temporary period and they will not be adjusting maintenance. I think it's better that you do not contact them about this, as they may speak to your ex and might give you a headache.
For the last part to your question, pandemic aside, the CMS are not interested in what nights are available/offered, they only work on what overnight contact actually takes place.
