[Solved] CMS Overpayment - Direct Pay

Hi All,

I had a CMS yearly statement on Monday which led me to contact CMS as it looks like I have overpayed to my former.

My payments have been based on the amount calculated by CMS and changed mid year although I did inform them and they gave me a new calculation so I expected the amount owed at the end of the year and what I had payed to tally up.

My question is; Has anyone else overpayed and was the overpayment recovered and how?

I dont expect my former to give me any money back but would the amount I have to pay going forward be adjusted to compensate my overpayment the ear before?

Wow, CMS hasn't been running that long and already it's going wrong :boohoo:

If the CMS aren't giving you a definitive answer on how to recover your overpayments (and I agree that reducing next years payments is the sensible way to do this), then perhaps a visit to your MP is the next step.

I can't see too many people on here being in the same situation - you might be in the unfortunate position of being the "trailblazer".

Hi Dave,

My Claim has been a bit of a fiasco so far too, though my annual review isn't until next month...

I contacted CMS recently as I'm rubbish at filing paperwork, and had misplaced a calculation from them.
I wanted to go back through all the changes, dates recalcs had occurred, amounts paid etc, ready for the annual review.

I was told that they "only had the latest calculation on the system" - what??
After asking how they did the annual calc if they only had the most recent one, a degree of backpedalling was done and I was placed on hold. After 10 minutes they came back to me with some figures and dates etc.

Since then i've found the calculation and found the figures they gave to be incorrect. The calculation for arrears is incorrect on the calculations and it would appear I'm making an extra payment in this year too.
This is coupled with it taking them over 2 months to add a newborn dependent on to the claim (still not on there now)

- As you can imagine, I'm not exactly filled with confidence for the annual review, or their calculations!!

Hi Badgerdom,

So far my expeince has been good but I dont want to end up in a situation where I get clobbered for arrears so am keeping a close eye on them.

I wasnt exactly filled with confidence with the person I spoke to but it is clear to me that I have overpaid the yearly amount.

I will wait for the revised statement and contact them again and update this thread.
