[Solved] cms nil assessment

i have been contacted by the CMS and have been given a nil assessment, i have been honest and told them that although i don’t have any earned income at present i do have a rental income, i don’t understand why..? they did mention that another department would contact me in the coming weeks about this, so i understand that in order for the cms to take the rental income into the calculation this can be done by a variation, my case started on 23 june 16, does this mean i will start paying a monthly amount or does the variation have to be applied for by my ex, as she doesn’t know i have rental income as we don’t have any contact and haven’t for over 9 years.what will be the outcome?as i don’t want any nasty surprises in the future for not paying, and I’ve told them everything,

If they have given you a nil assesment then until they contact you then this will stand, I'm not sure how variations work, but if you are concerned then you could put some money aside each month ready for when they contact you, if the amount you have put to one side doesn't cover what you may owe, then speak with them about paying the extra over a few months.

I think you would need to declare the income to CMS, but I'm not sure why it would need a variation, as presumably the rental income is declare to the inland revenue, so it is taxable. I'd do as suggested above and work out what the maintenance would be based on your rental income and put that aside in a savings account.

Thank you everyone for the replies, I have put aside the money since my nil assessment , I have spoken to the CMS about this, they say they have tried contacting my ex by way of numerous phone calls and letters , but she simply doesn’t reply.... I think this maybe the reason why my case has stopped and here it is October 3rd 2016 and I still have a nill assessment....

Hi there

It's difficult to know what they will do, we have so many stories on here of them contacting members years later with a huge bill for arrears, reaching into the thousands sometimes!

Perhaps you could might do well to get something definitive from them in writing, so that you have that should you need it.

The fact that she hasn't replied doesn't mean that the case is closed, at least I don't think so.... You could ask for clarification on that when you write to them.
