I pay my CMS every month on time, my ex continues to try to switch it to collect and pay.
This time they just confirmed it despite be submitting evidence etc.
they now want an eye water sum I can not afford every month and have put mu account into arrears. To the point it would be easier for me to give up work and let my partner go to work and i take over the stay at home dad role.
my question is, my current partner seems to think despite us living in the same address it would go back to normal if not less?
Has anyone else done this?
Hi,
If you have been wrongfully put on collect and pay, you should put complaint in. Contact your MP and ask the, to raise a complaint on your behalf. If arrears are genuine, they should let you spread repayments over 2 years as minimum.
CMS only interested in your income. Not your partners. If your not working, you need to let them know asap, so they can put you on nil rate (pay zero maintenence).

Can my partner claim CMS for our two children even if we live in the same address?
I am on Universal Credit and they take from that as well.
