Hi, I’m after your opinions/expertise if possible.
And I want to ask if CMS ever do backdated adjustments?
Can I first say that I’m the Mum and the receiving parent in this case.
The situation is in December 2016 we moved over to CMS from CSA, the maintenance calculation was done using HMRC 2015-2016 based on income of 40K. December 2017 CMS do their annual review using HMRC figures for 2016-2017 and now income is 75K.
But ex provides 2 wage slips to show current income is now 45K. CMS adjust their calculations and it is now based on 45K.
My question to CMS was what happened to the 75K? Their answer is they don’t know...
So for 2016-2017 ex was paying maintenance on 40k, but his salary was actually 75K.
I’ve asked the CMS to look at it again.
Any advice?
If you can prove that the salary is actually £75k, then you may be able to get them to revisit this, but otherwise they can only work on the figures that have been provided to them by HMRC.
Stop trying to be greedy, it happens all the time. Mums trying to take as much as they can off the dads the subsidise their own lifestyles. £45k will give you more than enough. I for one hope he’s managed to beat the system somehow.
