We are currently over 4 and a half years into a tribunal against CMS as we have been overpaying and CMS have added fake costs and arrears and now while awaiting tribunals decision the CMS have now put my husband on a DOE and added thousands in backdated costs as they say we have not been paying since annual review last year as the receiving parent lied that she wasn’t receiving her money! We have never missed a payment, ever and I have uploaded all the evidence that payments were indeed made but CMS won’t listen and when I got a little animated, quite rightly at the situation the case worker put the phone down on me, I’d been on hold 2 hrs! How is this fair when we have all we need to show we have paid but CMS have unfairly and unlawfully changed us to collect and pay as a witch-hunt to get yet more money when we have been paying on direct pay and as per our CMS letters?
What can we do here? CMS have not cancelled a
direct order from the tribunal judge and are just making changes which are just unnecessary as evidence has been supplied!
