[Solved] CMS got it WRONG.. and I can't afford to pay

Well basically I left the marital home last November.
I have 5 children, one is aged 18, all are with their mother.

Based on my income, I calculated using the CSA's own calculator, that I should be paying £380 per month.

I told my wife I would pay her £400, and in December I transferred £400 to her bank account and marked it 'Maintenance'.

My wife, unbeknown to me, had also gone to the CSA and opened a case.
In January I got a letter from CMS stating they had worked out my payments as £476 per month!
I told them I had already paid £400 in December, and that they had got their calculations wrong. Somehow they had my salary as being some £4,000 higher than it actually is!

Just as a side note - because I dared appeal to the CMS, my wife stopped me from seeing my children!

Anyway, the CMS said they take their figures directly from HMRC, and because it wasn't 25% wrong, then they wouldn't be looking to review it for 12 months.

I can't do anything about this apparently!
My income is £1,550 a month. It would be £1,630 but I pay tax on a staff mortgage, which is the mortgage on the house in which my wife lives! (She is paying the mortgage)

I pay £423 a month to travel to work on the train. Driving would cost about the same.
I pay £700 a month for rent, bills and food.
So this means I cannot afford the CMS payments, or if I pay that, then I can't afford to go to work, or maybe I shouldn't eat.
I certainly can't pay my credit card, pay for fuel for my car, or pay to take my children for a McDonalds.

I am on the edge of despair here, I can't think of anything else other than to just disappear from the face of the world.
Why won't the CMS (or CSA whatever they're called) listen?

The CSA are like gangsters! 😡

If you have tried and they wont listen then you could go and see your MP. Others in similar situations have done this and with some success...its worth a try! You should be able to get an appointment quite quickly. take all the paperwork you have and maybe write down the points you want to raise so you dont forget anything!

I presume that the staff mortgage is because you work in a financial institution or similar and are getting a low rate of interest. Perhaps your ex should remortgage the property in her own name at a normal interest rate - that would give you back the 80 per month that you are paying in tax and would make up the difference in the maintenance payments. Of course, your ex would be paying much more in mortgage payments than the extra 80 per month - she might see that it's in her best interest to close the case with the CSA and go for a family based arrangement with you at 400 per month.
