I've spent 12 years fighting against arrears I don't owe, and they keep getting bigger. Currently standing at £31,000 and yet I've paid the mum the correct amount from my income every month without fail for 12 years. The problem? they repeatedly go back through my case and change the assessment of what I should pay retrospectively without letting me know by bumping up my income without any reason or evidence and without my knowledge and without an opportunity to appeal, so despite ALLWAYS paying the correct amount and ALLWAYS paying what the CMS asks, I am still in massive arrears. When I phone the CSA they give up trying to work out what happened in my case as the size of the file is an entire filing cabinet (their words). Currently trying to get the tribunal to look at it, but they've been asking for different bits of evidence for the last 6 months so no progress. I've asked the CMS for my case files under the freedom of information request but I've had nothing. Now they are demanding I pay the £31,000 over the next 8 months regardless - even though it's about 80% of my net income - so I stand to lose my house and go bankrupt. There is no way to stop it, there is no opportunity to defend myself in the courts, and there is no response to my freedom of information request. I am literally totally F***ED!!! - I've done nothing wrong, been 100% honest, and paid 100% of the money asked of me when they correctly assessed my income. It's like the f**king mafia - you have no power to complain for the injustices done against you - and the cause is ....... complete incompetence, for example, part of the arrears is because the computer system forgot to assess me one year and I didn't get a letter, so I carried on paying the same amount, so on the 'system' I was not asked to pay anything therefore (obviously to them???) I didn't pay anything - then 3 years later they retrospectively correct the mistake on their system, and boom! my arrears go up by a full year of non-payments that were actually paid AND they refuse to take those payments into account..... it never never f**king ends
hi, CMS have been offering a minimum 2 year period for people to pay back arrears for smaller amounts, so 8 months is very unfair for a large amount. have you tried contacting your MP for help?
