been paying CMS to the scrounger since day one. never missed a payment, pay via direct pay straight to account
i was due a annual review this month and also my travel arrangements have changed so i rang in to inform them of this. I was told that a form for travel variation would be sent out. waited 3 working days ...no form sent
rang again . the lady on phone checked system and told me no form had been sent. "i will send you one out today"
And also a letter regarding my annual review will also be sent out aswell.
I received the letter re my annual review saying it was NIL contribution asessment according to their records.
So i rang in on the saturday of receiving letter...told them this is clearly wrong as i was working and they should have my P60 information to hand. A call back request was logged
come monday...i decided to ring back myself and was told ...ignore the NIL contribution letter...your annual review is due in 3 days time (wednesday ) so you will have the new payment schedule by this saturday (today) and the form for variation for travel expenses aswell.
Today Saturday 23/09. I received my annual review letter again it says its NIL assessment but this is clearly again wrong as i am working and was working last year aswell.
I think these clowns are deliberately trying to do this so then then can sting me with a collect and pay order.
This isnt the first time the CMS have messed me around re calculations. las time they screwed up i ended up over paying by nearly £1500.
now they say i owe nothing when i clearly do
i have logs of all letters received.
all dates/times of calls and first name of person i spoke to
What should i do?
Has your income increased? If so, I would say that you should continue paying the current amount, as they can't say that you haven't paid, but I'd also consider putting into a complaint to make sure they get it right.
Phone HMRC or log onto your Tax account.
CMS get their info direct from HMRC - based upon pretty standard info ( National Insurance No etc ) . It would seem CMS are getting the wrong info - which might indicate something else is wrong somewhere else overall with your HMRC identify or tax setup or something. Worst case scenario of that is that HMRC are also taxing you wrong and by default you are paying to much or to little.
Is also worth checking because if there is some sort of identify/connection issue with "you" as exists in various systems then it might also cause flags with credit applications, mortgages, security checks and similar.
I would do as actd said and carry on paying the current amount to avoid trouble further down the line.
If you're not getting any joy once you've checked with HMRC - try speaking with your local MP or CAB and they should be able to help you deal with the CMS....

*actd..my payment schedule for the current year is now finished and ive made my last payment that was due for that schedule. This week i was due my annual review and they should have sent me a new calculation based on my 16-17 tax year earnings. (approx 5%) more than last year due to slight annual increases , therefore i am liable to pay. The new schedule should have told me new payments but it states NIL.
*david …I have spoke to a cms rep (didnt help much except tell me what i already know. He was able to confirm the figure he had in front of him from HMRC matches my most recent P60 so no issue there. He confirmed and checked my NI number it was correct. my tax code is correct on my payslips aswell. So there is no data error.
*So i asked him....how can you tell me you have my earnings information in front of you stating xyz amount earnt clearly meaning i am liable to pay....yet im getting letters stating NIL payment, He said "yes there seems to be a problem".....no [censored] sherlock!.....
Ive requested yet another call back....and i have wrote a letter to them explaining the problem.
I have told them that they cannot put me on collect and pay if they try to because they are the ones telling me i dont owe anything hence there will be no more payments to ex scrounger till its sorted, because they state i dont own anything.
I cannot believe the level of negligence and incompetence from this so called government run agency,,,,it appears the clowns at the call centres are on a different planet...taking calls, looking at a computer screen with no or little training other than a basic script/tree diagram of questions and answers to run through....most of which end with a call back request,
last time they ignored my variations requests re overnight stay /travel and contact costs etc for 9 months leading to an over payment of £1500 now 1 year later...its the opposite...NIL payment which will no doubt result in them chasing me for money and increasing payments to make up for arrears.

You could go for the complaints procedure, that might focus them a little more.
i had a call of the "case worker" stating thank you for point that out.
A computer error has apparently put me on a NIL asessment
however, they said they will be reviewing it.
In the mean time...she looked at my previous years (most up to date) earning, used my circumstances and gave me a rough figure to pay...she said start paying that every friday and once my payment schedule comes through just compare my payments against the actual ones on schedule, work out difference and add that to the next due payment to balance things out (or subtract if the schedule states less)
Do you think this is reliable advice? i dont want to pay and they dont take these payments into account when doing the schedule i.e add arrears into the payment plan ?
I have wrote a letter in stating whats gone on, and a travel variation request, they confirmed its been received but they cant give me a time frame of when it will be dealt with
It's tricky to advise - I would certainly make sure you don't pay more than you think you should be paying, and make absolutely sure that the payments you made a very clearly marked as child maintenance payments, so there is no question that you have been paying.

i have been paying via bank transfer and marking it with my sons name and maintenance
But today i had a text stating what the amount will be..trying to ring CMS but operator states due to exceptional circumstances we cannot take calls try later
i looked at my online account and the payment schedule
and it comes to me with no surprise that the two payments i have made are not mentioned at all on there,,,,my last schedule ended with last payment on friday 22/09 and therefore new schedule should have started on 29/09/17. (there is no grace period)
but they have missed off two fridays (with the assumption i didnt pay, added on the two "missed payments" as arrears to the overall calculation and started the schedule so that my FIRST payment is 13/10/17
This is clearly wrong as i was told by the case worker to pay a "rough " amount which she quoted to me, until its all sorted and to address and ups or downs on the next payment when the calculation comes. so it would have been a few pence up or down but according to their schedule i am in 2 weeks arrears , which has been divided by 52 and added on to the who years weekly payments!!!!
i have emailed them via online account. so see what they do..
