Help !!!! received a letter from cms last week saying I owe arrears of nearly 9 grand ,4 to my ex and 5 to the state ,how can this be as I've always paid direct to my ex .Can someone help as I don't know what to do ,I have phoned the cms and have been told to wait as they are looking into it !!!!.
what are arrears owed to the secretary of state ( the government )???
While you wait to hear back from them, gather any evidence you have of the direct payments you have made.
Your local CAB office might be able to help but you should consider contacting your local MP as they help with these matters.
hello,i aint got any proof of payment except my kids word because they collected the money.they are 16,24,25 now and are willing to back me ,not sure if I can trust my ex 100%,although she has done me a letter saying ive always paid .think its the government arrears which are the BIG problem as I aint got a clue where they come from .maybe a fraudulent claim!!!!!!,thanks
Why would I have to pay for my ex while she was on benefits,i payed my csa now there saying I owe the state,i was never told about this before as I would of sorted it ...This is so wrong ,can anyone help
I'd certainly ask for a breakdown of the arrears. You were presumably on the pre-2003 scheme. I believe that originally, maintenance or benefits were paid to the mother by the state, which then tried to recover this from the father.
I never started paying until 2004,would this make a difference?
I'm not sure to be honest, I don't have much knowledge of the pre-2003 scheme other than a few basics. It's possible that you are on that scheme, but that it took them a while to get it started. Certainly the fact that money is owed to the state does imply that it's that scheme. I'd definitely ask them for a breakdown and question everything that doesn't look right.
Ok thanks !!
I think my ex is gonna do me a letter saying I've always paid her Csa ,the money I am supposed to owe the government I'm sure she told the benefits I wasn't giving her money and think that's where the arrears come from , hopefully find out soon buy the way my ex is acting, idont trust her ,sure she's hiding the truth because i know she would of also had a letter of Csa.rant over !!!
Mothers on benefits were only allowed to keep maintenance payments without it effecting their benefits from 2010. She must have told them she wasn't receiving anything from you so that she would receive her full benefits. Is it likely that she will admit that she was claiming fraudulently?
Thanks for that info !!.Not sure what to do now ,just have to wait and see what csa say and I know they are full of s...t !Gutted !!!!!!
