[Solved] CMS and sick pay

My partner pays for his 2 kids(10 and 13) through CMS. 3 weeks ago he was involved in quite a serious motorbike accident and is on a long road to recovery. As soon as he was discharged from hospital he informed them that he is on SSP from 24th March. They said they would get the info from HMRC and he didn’t have to do anything else. A week later he called back to see if it has been adjusted and he was given serious attitude and told he has to send evidence. He called back later that day and someone else now said it has to be done online. He uploaded a copy of his sick note and hospital discharge letter. According to the maintenance calculator he should be paying £30.30 per month however, their new calculations state £205! This is 50% of his sick pay! On top of that he is now over £300 in arrears even though yesterday he was £5 in credit and he has never missed a payment. He has sent them another message as it just doesn’t seem right. It’s causing us a lot of stress as I’m furloughed and will basically have to try and cover all rent and bills on my reduced income. Does anyone know how they could possibly have calculated the amount above to be correct and how likely it is that it will be readjusted? Thanks

hi,

as it was only 24th march, i doubt HMRC would have any record of this. they probably will when CMS run a check next year. from what i read is they class statutory sick pay as earnings and deduct from that. they should be able to give you a straight answer on how much they deduct off sick pay. if they can't, he should make a complaint:

I would also suggest he rings them and tells them he's making a complaint - that might just speed them up a bit, but still make the complaint anyway and only withdraw if if they cancel the arrears (in writing) and recalculate correctly.

i just spoke to them. i started new job beginning of april. regular perm job. they just kicked me out. i uploaded my job contract and termination letter in self service portal.
i rang them and they put me through to case worker. said will set my maintenance payments to zero ASAP. seems like its very straightforward i you have perm job.
