Hello. My son 8yo lives with me 6 nights per week. This arrangement is from June. Prior to that he was staying with me 4 nights per week. My ex still claims child benefit and tax credit. I called CMS and they told me that she not supposed to be claiming anything and I should open claim against her . They have texted me link to application with reference number. My son chose to stay with me as he was upset and angry when at school so back in June he with me 6 nights per week. I didn't change GP address to mine because I expect them to start calling ex and eventually fob me off,as they do to fathers everywhere. So I'm avoiding the disappointment. I wanted to apply for CB but am afraid that they will also find a reason to not give it to me. Yesterday my ex got viewing for 2 bedroom flat and I'm upset she is claiming property when my son is not even with her. CMS people told me on the phone to apply straight away. But i have doubts. Can someone please tell me what to do? I spoke to family lawyer and was told to not go court since ex is not causing problems and arrangement is amicable. Lawyers seem to not understand that welfare is important part of taking care of child especially in London.

hi,

so according to your arrangement your basically the primary carer for your child as he lives with you. I think you should apply for child benefit and maintenance ASAP. also good idea to change GP and school if there's more local one to you and you think this arrangement will be a permanent one.

@bill337 school is close to my house. It's further from her now as she will probably move 2 miles away. GP is also local to both of us. So will she keep the flat if I take CB?

@bill337 Also her sister is single mother. She got flat in South London next to new built American ambasy. Luxury flats I saw advertised for £800k . Are you telling me that those irresponsible women get to keep a flat which only 0.5% top earner of this country can afford?
