[Solved] Cm Payments while furloughed.

Hi All, would appreciate some opinions or facts please
I have a private cm agreement with my ex for my 15 year old daughter.
Last month I was furloughed and have really took a hit with income, is it still expected that I pay the full cm amount while furloughed and if not, would I be expected to make up the shortfall once I become unfurloughed?

Hi there, as you have a private CM arrangement, the matter can therefore be dealt with privately by you and your ex. You can make whatever changes you like, but it would be best to try to seek understanding/agreement. I'd advise talking to her if you're able to, and hopefully you can come to an alternative arrangement during the period of your furlough. Perhaps you can give her a firm undertaking that you will reinstate the original level of payment when this particular crisis is over, and your income returns to its pre-furloughed level. Whether you agree to make up the shortfall at a future date is entirely up to you.

If your ex isn't accepting of any of this, her recourse would be to make an official CM application. As we're in uncharted territory with the pandemic, I'm not sure that the CMS could enforce a payment calculated on your original salary if you are clearly not making that at the present, and would assume they would have to make calculations on your furloughed income - but I can't say any of this with certainty.

I use the CMS and they have advised me to pay what I can, when I can currently. They've said that they will then require proof of what I have paid before working out what I owe etc,

Unless your furlough is a 25% loss then they won't make any changes to existing cases. I would assume if you had to go via CMS they would ask for proof of furlough and then work your CMS out based on that income.

I had a 10k payrise just before I was furlough and they said they wouldn't use my new income until I was back to work as normal.

They did ask for proof of my furlough also.
