[Solved] Cm driving me crazy, please help

I am currently going through a child custody hearing

I decided in September that I could not concentrate on my work, due to the nature of my job, it was the right decision as I couldn’t focus

There I am on a long term sabbatical, I advised the cm team that my final payment will be in November, all thought I stopped working from November 1st, I got my November pay as it’s an employee benefit

I uploaded a letter from my employer the rest of my leave is unpaid

Someone opened a change of income based on the letter

Now just the other day, my December pay came in as a £200 tax rebate, that’s it. I didn’t expect this but when I found out I told them right away

My wages are showing as 0, I then got a letter asking for proof of income and I have to continue making my payments

I phoned up and the team told me looks like they got in a loop and didn’t see my payslip before sending the letter, so they are processing a change of income now (they must have declined the last one I assume which is why they sent the letter out because some dumb [censored] didn’t wait until my payslip showed up )

Now all of my money has gone on this court hearing, I’ve got nothing, I am living with family who are supporting me , that’s it

They are asking me to pay my December child maintenance !! As the change of income hasn’t gone through

Despite me telling them in October and November several times I am getting no income in December and despite them seeing all I got for December was a £200 tax rebate

The person on the phone says I have to pay £350 in December

Do you see what’s wrong with that ? They are asking me to pay more than I actually as a tax rebate ! I’m happy to give the whole tax rebate to my ex but I got nothing else

This surely cannot be right! How can they expect me to pay on December when I earned nothing ? I understand them having to wait for a payslip but surely my December cm payment should be the minimum or be removed ?

I literally cannot afford it, I have nothing and earned nothing on December bar the rebate

The lady suggest action will be taken against me? How can these people lack such common sense ?

It’s plain stupidity

I have put in a complaint but what do I do when they start chasing me for the payment ? I didn’t earn any wages, I have no means to pay, I’ve told them this and they basically said to find a way

hi,

thats annoying. keep chasing them, ask to file complaint, or if they can review your case, go to tribunal. or if this is going to be so long-winded, perhaps you can find a way/get family support & pay the maintenance for december and leave at that.

Keep disputing it, complain etc. Like you say they have all the information and payslips etc.
They can't force you to pay. Usually for ongoing non payments, they get your employer to deduct the money from payroll, but in your case they can't do this as you are no longer receiving payments from them.

Complaint did the trick

They apologised for their mistakes

The repercussions of this has also benefited me, the devils daughter decided to kick up and fuss with her solicitor and added in a considerable amount of allegations out of nowhere with no evidence which the judge was not pleased with at the slightest
