hi all I just wonder if anyone could help me my son is nearly 19 and in full time work should I still be paying csa? also my daughter will be 18 in july do I need to pay for her as she has left collage thnaks

Hi

My understanding is you pay until the children finish full time education

My son is 18 but still at college but I stop paying when he finishes his last exam in June

Child Maintenance is payable whilst your children are in full time education no higher than A-Level ( or equivalent course).

If you have a family-based arrangement in place you may wish to discuss and negotiate with the other parent regarding your maintenance payments. Family-based arrangements are not legally enforceable and there are no strict rules or formulas to stick to. Therefore, parents can decide the terms of their agreement to suit their current circumstances.

If you cannot come to an agreement on when your payment will end, you may wish to follow the guidelines of the Government’s statutory scheme. Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. Before 10 December 2012, the upper age limit was 19.

However, if your child was 19 after this date and in full-time education, maintenance would be paid until the age of 20. In addition, if arrears have built up on a case, those arrears must still be paid, even if regular child maintenance payments have stopped.

When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September. If you would like further information on when child maintenance payments end and for the courses that are classed as full-time education, you may wish to visit the following website https://www.gov.uk/when-child-maintenance-payments-stop.

If you have a case with the Government’s statutory scheme you may wish to contact them directly to see where you stand regarding your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

If you have a Consent Order/ Minute of Agreement in place you may want to see what is stipulated within your agreement to when your payments will end. Alternatively, you may wish seek legal advice to see where you stand with this.
