[Solved] Child Maintenance Service Refund

On 28th February I recieved a demand from the Child Maintenance Service for my 19 and a half year old son. They wanted me to pay £407.28p per month. They started taking the payments directly from my wages via an attachment of earnings order.
I challenged the decision via a mandatory reconsideration because I believed it to be a claim without any foundation, and on the 8th July 2014 they sent me a letter saying they had overturned the original decision and that I was not liable for maintenance payments from the effective date.
Since the 8th July 2014 they have taken a further two monthly payments of £407.28p direct from my wages. In total they have taken £2036.40p from me and I have been trying to get them to refund the money to me since July without any success.

I have tried contacting them but you speak to a different individual each time, none of whom appear to know what they are talking about. I am phoning them on an almost daily basis but I am still having problems getting them to refund the money. Yesterday I was informed they were contacting my ex wife to see how she intended to repay me (No chance). I have told them that I will not except any form of installments and I want my money back in one lump sum but still they seem reluctant to refund me despite finding in my favour. I have complained to the Independant Case Examiner who is inundated with complaints and cant guarantee when they will look at my complaint. I have written to my local MP and Iain Duncan Smith at Dept of Work and Pensions and asked them to intervene.
I just want my money back but now dont what I can do to make them refund me in its entirety. Can anybody help please.

I think you have covered everything we could suggest - especially your MP who can raise a complaint at a higher level than you can, so I would chase this up further. It might be worth speaking to the Citizens Advice Bureau - I would consider that by taking the money when they have no right (by their own admission), it's actually Theft.
