Hi - I had to access and use the bulk of a pension totalling 97385K a chunk of it on a criminal case brought before me for attempting to stalk my former wife - eventually proved nonsense and I received an admonishment. Another chunk of the pension funds were to pay all legal fees involved in trying to receive contact with my 3 younger children aged 8, 8 & 9 The funds were only showing with HMRC for one tax year and I have shown a letter proving that there is nothing left in my pension fund. I have also provided the latest tax return for my self employed Videography wedding business which is year 15/16 and they are now saying that it is an old one and that they will have to revert back to the figure quoted above and use that as income for this future calculation.
SEEMS GROSSLY UNFAIR - self employed do certification through an accountant and my next one for 16/17 will be done as normal in January 18

why are they saying it is an OLD one ?????????? By the way my business has folded and I am living on some of the pension left - and have no income currently but hoping to secure more work

I would provide them with evidence that the business has now folded, and it might be worth going to see your MP to get them to raise a complaint if they are using inaccurate figures.

Write to your MP . Give details of you current situation and ask that it be brought in front of the CMS complaints review team .
