[Solved] Child Maintenance Query

Hi All,

Quick question for you all:

I have recently split up with my partner of nearly 10 years. We have 2 kids, ages 6 and 4, together,
I am being asked and I'm 100% willing to pay some kind of maintenance and I have been on the official .gov website to get an amount.

The query I have is that I currently pay for my ex's car, that she uses for herself and the kids, along with the tax each month for this car and her mobile bill.
This all amounts to approx. £180 pm. The amount of child maintenance is approx. £200 pm

Both the car and phone are in my name but I'm not 100% sure where I stand officially regarding offsetting these against the maintenance??
Should I cover my back and get a letter signed by my ex with these costs on and explaining the situation??

I had a similar issue, paying CM but was also paying the finance at £149 per month on the car that was in the possession and solely used by my ex.

CMS take it into account, but unfortunately not by taking £149 off your paid CM!

They multiplied 149 x 12 = 1788 and took this amount off my assessed gross income. So it made about £20 per month difference in how much I paid a month.

Still welcome, but when CM is £567 and you are paying £149 on top for car finance, the £20 did not feel reflective of that. Fortunately I have paid it all off now......

I'm afraid you will find that the CMS wont take any of these costs into account. You will have to pay the full amount.

Best thing to do is to come to some sort of agreement between yourselves, which includes you paying for car and mobile bill.

If she does get the CMS involved then you may have to think about stopping paying for these items.
