I currently pay maintenance for two kids via the CMS. For the past year, my youngest (17ry old daughter) has not bothered to stay over at mine even though I pay for 1 night a week (her decision, not mine). The mother, has now after 1 year, decided that she wants me to tell the CMS. Can the CMS go after a back payment for the past year she didn't stay over ?
hi,
they can back-date if they decide.
Hi
The other thing to consider is that they will ask you why you haven't notified them sooner which I believe is one of the mandatory updates you need to provide if anything changes.
You can approach this in one of two ways depending on why your ex wants you to tell CMS.
You can tell them the change has happened from now and therefore your payments will be adjusted going forwards. Or you agree with the ex what date the change happened and inform CMS and they may backdate and also adjust payments going forwards. This may put you into arrears if you do not settle straight away.
It all depends on whether your ex wants/needs the arrears..
