[Solved] Child maintenance ...Italian Court Order

Hello

I was hoping someone could help or at least point me in the right direction.

My partner married an Italian in 2008 they separated and he has been formally separated from her for over 3 years.

When they initially split he was served with an Italian Court Order stating that he pays 900 Euros each month for his 2 children.

He has been paying this for the last 4 years however he is now struggling to pay. He can no longer afford to pay this. He has been living back in the UK for the last 6 years. He is British she is Italian. He wants to pay for his children but a fair amount. He is struggling to live.

Can anyone offer any advice of where we need to go. We are both struggling. It is all made so difficult because she is Italian and he married in Italy.

Hi

I would give CMS a call - in the UK, CMS can override a court order after 12 months, so it would be interesting to see if that applies to european orders as well.

We could try however I feel they will only deal with cases here. Just both falling down a black hole at the moment. He can’t afford to live, it’s a ludicrous amount of money each month.

I would certainly contact CMS quickly to find out - if they can override the order, it's best to do it now. After Brexit, that might change as the position with foreign courts could change.

CMS re unable to help because it was made in Italy. Spoke to gingerbread charity no joy either. I cant believe there is no help out there for this. I personally think he just needs to pay what he can afford and let her fight it from Italy.
