[Solved] Child maintenance in concent order.

Hello all.
I am in the process of setting up the consent order.
In the recitals I have a paragraph setting out what I agreed to pay (more than the CSA calculated) and the next paragraph stipulates that the amount is up for review if my employment circumstances chance ie I go part time or become unemployed.
What would be the difference if this is in the main body of the order or in the recitals?

Just a thought, but wouldn't it be easier to open a case with CMS and then put in the order that it's being dealt with in this way? You could possibly put in the order that you agree to pay a certain percentage above the CMS calculation.

Hi There,

I agree, if you put it in the hands of CMS now then there is no come back later, and as said you could agree to pay over this, but state that if your circumstances change then this would have to be reviewed

The difference between recitals and the main body of the order is that recitals are not enforceable, they are there purely for context and to help tell the story of the case or why certain decisions were taken.
