I have separated from my now ex-wife for 6 years.
When we separated I had a relatively modest income (~50K). I paid child maintenance based on this. This income has steadily risen and so has the child maintenance payments.
Over the past 4 years my income had steadily risen some more. First it has risen to just over 150K. Child maintenance through CMS is capped at gross income of 3K a week (which is just about 150K annual).
My income is now ~400K.
CMS will still calculate based on a cap of ~150K.
At the time of separation, a parent can ask the court for a special arrangement for higher income individuals. There is case law that determines child mainteance at the time of separation based on the entire income.
However, I found no precedent for individuals whose wealth has significantly improved some time after the separation.
I'd like to understand the likelihood that I will be ordered to pay more, if the other parent decides to go to court.
I will also talk to a solicitor about this, I'd like to know if people have had experience with this.
