I wonder when child maintenance starts . ?
I am still going through divorce but we still live in the same jointly owned house . It is being sold but taking a long time so I think she might leave and live with her mother with the children .
My question is when would child maintenance start as we still own the house together and she can live here . Meanwhile she does not work and I pay everything. In that scenario I could not afford child maintenance anyway if she left but would I be expected to pay ?
My other question is I understand I can make reductions to child maintenance for travel costs as they will live far away and my petrol will be on average more than £10 a week so I can take this off maintenance?

Tough one this.
As soon as she moves out she can raise a claim for Child maintenance from the CMS, and they will believe every word she says. It wont matter that you are paying everything, you would still be expected to pay, unless you could prove that they are still living at your address. It really depends on how reasonable she is being.
I would suggest that you try to keep you all in the same house until it is sold, try for the angle that it is best for the kids etc. Going to her mothers may not be the best outcome right now.
