Hello
I’ve just had my renewal letter from the child maintenance service, and they have gone by last years p60 for what I earn in order to determine what they will deduct going forward
The thing is, they haven’t taken into account that I pay 10 percent towards my pension?
They have calculated the amount I have to pay on my whole wage, before pension, not after?
Any advice anyone?
Thanks
Jonathan
I would contact him in the first instance, hopefully they can make an adjustment.
OK this is a tricky one..... and yet it could and should be straight forward.
1.
They have used you most recent P60 from April 2017. However this P60 does not show that you have been contributing into a pension scheme to the tune of 10% of you monthly pre-tax income?
2.
This is to a company pension scheme, and the contribution is reflected in your monthly payslip?
If so... then this is what you need to be aware of:
1.
The time limit for asking for a review is one month from the date of the letter telling you about the decision.
https://www.citizensadvice.org.uk/family/children-and-young-people/child-maintenance/child-maintenance-2012-scheme/child-maintenance-reviews-and-appeals/the-2012-child-maintenance-scheme-challenging-a-decision/
2.
However PLEASE NOTE THE FOLLOWING VERY IMPORTANT.
The CMS will only usually alter their calculation if you current income is shown to be less then the calculated income by 25 per cent or more.
So if your income less pension contributions is not less than what is reflected in your P60 by at lease 25 per cent, they will stick to their calculations.
So if your circumstances match as described above.. then:
1.
Call immediately and inform them of the above.
Say that you are formally requesting a review because you income, and that you shall be sending in supporting information by way of payslips ASAP.
2.
Send in at least your last 2 months payslips. That is usually sufficient (although they may sometimes ask for more backdated payslips).
