Child maintenance and Ltd Company

Hi everyone,

I have been paying child maintenance for 2 years now and have never missed a payment. I still pay despite not seeing my son in 15 months (she won’t let me) due to an abusive ex partner. She is currently on bail, the police are 9 months into the investigation and we are closing in on the final stretch. 

Last week I recently just set up a Ltd company because my accountant advised me to due to the amount of income I earn.

Do I need to inform the CMS about this situation as I’m sure my income has now changed.

However, my accountant said we can’t provide myself with a wage until the end of tax year in April 2025. Does this mean I technically don’t earn a penny currently as it’s all going into the business and I should tell CMS this? Of course I don’t want to avoid paying anything completely (although it’s tempting to try and get her to let me see my son) as I know my sons livelihood is heavily relied on my support due to my ex not working. 

I don’t want to get in trouble by not paying although a lot of people have advised me to. 

I currently pay my ex partner £500pm for my 2 year old son through CMS and it is usually reviewed in October / November of each year. 

Has anyone experienced creating a Ltd company and what happened? Will CMS change the amount immediately from next month after the report or will I have to wait until I have evidence (April 2025) that I am only paid X-amount through a wage and dividends?

hi, 

you should inform them of LTD company. its likely your payments will stay the same until they see your next tax return in 2025.
