Child Maintenance and EHCP

Hi

My son has an EHCP (Education Health Childcare Plan, previously called a Statement of SEN) and will be 20 on 14/10/21.  He finished college, as confirmed by them, on 02/07/21. 

My question therefore is does his EHCP affect whether his mum can continue to claim child benefit for him and therefore make me liable still for child maintenance payments?

Hello

I'm not sure about child benefits. I have the feeling that CSA (again, I'm not sure about CMS) didn't always deal with maintenance where there were special needs that involved additional expensesover normal childcare, and that the courts then had jurisdiction over these cases and could order child maintenance beyond the normal age cutoff. It might be worth having a consultation with a family lawyer (you may be able to get a free 30 minute consultation with one) to clarify what the current position is with this.
