We are currently paying child maintenance, but have been informed that the child we are paying for is at university and has a grant.
We have informed the CMS, but they say they have written to the mother, without reply, surely this is fraud?
We don't mind paying providing the child is indeed only studying to a'level, level. However if the child is at university and has a grant we should not be paying and therefore, mother is pocketing the money. The CMS seem reluctant to follow this up and say that if she doesn't reply we simply have to keep paying until the child is 20?
Surely there is some sort of enforcement procedure?
Does anyone know?
Does the university have any piblicly accesible records of its students? That might be suitable proof - otherwise you could speak to your MP to get them to raise a complaint.

I had something similar when my eldest son started his appreticeship, under the rules that meant i didnt have to no longer pay for him. When i contacted the CMS they told me that the mother was still claiming Child Benefit therefore i still had to pay, unless i could prove he was working. Even though i did prove that he had a job, it took for the mother to stop claiming the Child Benefit before the CMS would agree that payments should stop. My advice is speak to the CMS, if the mother is still claiming Child Benefit and she is entitled to then you might be bugga'd. but if she is claiming it incorrectly you could report her!
In my experience its very hard to get the CMS to listen to you, only the mother has that power!!
