i am currently unemployed and i have rented out my house over the last year, i got a letter from the csa, , the csa told me and i also read that rental income isn’t classed as earned income, i have told them again about the rental income and now they say its included, as my case was closed six months ago but now they say they are a different organisation and my calculation will start this week on the 24th june..... does this mean i will get backdated or will i just start paying from this week..... i have been honest with them and the person i spoke to said this calculation if for a new case starting this week...so i don’t know if i trust his word or not.
Hi there
If the case was closed 6 months ago then your ex must have made a fresh application for them to open another claim. It will start from the date they have given you which is 24/06.
I was also under the impression that rental I come under a certain amount was included, perhaps someone else will know for sure...sorry I can't be of more help.
You might find this CMS leaflet useful. On page 38 it states that they will use unearned income such as rental income when making a calculation, but it must be over £2,500 .
Thank you both for your reply, very much appreciated. i was given that date and told it would start from that date, its just that reading online in other forums there are so many nightmare stories of dads who have been ordered to pay arrears for the last 5 or 6 years. When i say the case was closed i understood that the reason for this was cmec was closing and it was a new organisation call csa, and i didn’t think it was my ex that had closed it.....? does this make a difference?
Another thing i am worried about and is causing me sleepless nights is that I’ve been reading that assets with equity over 65k are included and worked out at 8%, whatever that means.... is this done or can my ex actually do this? i read in some forums but I’m thinking this is the case if you own a second property, as my rental is my only home. is there anyone who can explain if this is the case or how and when this is done...i wasn’t married by the way, and my ex didn’t pay or contribute to the mortgage or any of the bills..... ... thank you in advance
Hi There,
.
As Mojo has said, they will only backdate the payment to the date the case was opened, so in your case 24th June, the stories you hear of years of back dated payments having to be made, are where either the paying parent hasn't paid and it has finnaly caught up with them, or where there have been issues with calculations there are other reasons, but if the case was opened on 24th June, that is as far back as they will back date it.
.
As far as I am aware, your home wouldn't become part of the calculation, however as you earn an income from it, then maybe the income could be, I'm not sure on this side of things.
.
I'm going to move your post to the child maintenance section so that the team can give you some advice as they won't pick it up unless it's in that section.
