Hi, me and my ex separated in 2018 he was married already and I left because he was abusive to me. Anyway skip forward to 2022 and he is now having contact with our son because I didn't want to deprive my son of having a relationship with his father. I've mentioned to his father that he should be paying maintenance but he has said that his wife is the only one with an income and I just wanted to know is there a way that I can get the csa payments from his wife's earnings if someone could get back to me it would be greatly appreciated
Hi
Unfortunately no, if the father has no income (CMS will check with HMRC) then his liability to pay will be assessed as a nil amount.
If he is on universal credit then he should be paying the flat rate which I belive is £7 per week.
You should open a claim with CMS as they will check his income on a regular (annual) basis to ensure that you receive any amounts due.
Hope this helps, all the best.
