Hi dad Info, I'm in a protracted battle with my ex who is in the family home with the two girls. In the Court ORder it states child payments start on 0/7/16 until 10/07/17 after which time the applicant (dad) shall pay maintenance in accordance with the appropriate CMS calculation. I have been paying this up until last month so have gone well over the allotted time stipulated by the courts. Both children have finished full time secondary education one is at college doing a public service course the other is going to do an appreticeship either legal or as an estate agent. The oldest is 16yrs the other is 18yrs. They have both finished their secondary education the eldest being 18yrs in October and the youngest is 16yrs on Monday. I have asked for details of my youngest daughters education plan but have received nothing from her, she only communicates through solicitors. Do I still have to keep paying maintenance, even though they are both finished their secondary education? Can I ask her to put the house on the market for sale so I can receive my share or do I have to wait until the youngest is 18yrs, effectively another two years. And do I have to pay for both or can I reduce to paying for one child.

her solicitor should be knowledgeable enough to tell you when you should stop paying maintenance. i take it that your paying via a private arrangement or your with CMS?

regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid.
When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September. The definition of full-time education is more than 12 hours a week of study, on a course up to and including A-level standard. If the child is in advanced or higher education such as university, legally, they will no longer qualify for child maintenance through the statutory service.
