Hello Crossie

With you having a case with the Child Support Agency (CSA) you may wish to speak to them directly regarding any concerns you have with your case or payments. You will find their contact details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.

Paying parents are legally responsible only for the amount worked out by the CSA and are not obliged to pay for anything extra. I have included a link on how the CSA calculates child maintenance that you may find useful, https://www.gov.uk/how-child-maintenance-is-worked-out/how-the-child-support-agency-works-out-child-maintenance.

For more information on the different ways to set up child maintenance and for a more personalised service, you can visit the Child Maintenance Options website at http://www.cmoptions.org.

Thanks William, what I am really trying to establish, and this is where it's becoming really difficult is should I be paying her anything. We dont have an arranegment with the CSA, we've alwasy done it privatly but I am reading is care is 50/50 and if the paying parent can prove that they carry out an equal amount od day to day care as well as having equal share then the Child Serivce regards this neither parent should be paying the other parent. The probelm is I cant find that difinitivly or offcially anywhere. I have called them and they said I should try and discuss with my ex but all she is interested in is the money so wont even talk about it so before I stop paying her I need to know if I can legally stop paying her based on these guidlelines that I am seeing, do you know when I can find out?

SInce you don't have a CSA case open at the moment, any new case with go to the CMS and they will use their calculation - the following link will help, but the important bit, if it is true 50/50 care, is that you don't pay any maintenance at all - you want the bottom of page 29 in the document
