[Solved] challenging CSA payments and mandatory recon

im new to this forum but wondered if anyone can help. Ive been divorced to my wife for the last 2.5 years and she the CSA wrote to her recently to let her know i owe her £1890 as a back payment and an extra £220 per month csa. She has withheld but now pressed the button and I simply cant afford it. I have a good salary but now new debts loans rent etc to cover before I cut into disposable. The CSA are due to write to me... how much do they consider a change in outgoing costs and disposable income when mandatory reconsidering new evidence

There has to be a consideration to live to a certain level? any help will be looked on with great thanks

Hi there

The CMS will only look at your gross income and will calculate the amount you pay as a percentage of that. They don't take into account any of your outgoings, although they will make a reduction if you pay into a pension, or if you have your child/children for more than 52 nights a year.

They do not back date payments and the claim will only start from the point that the mother opens a case with them, so your comment about her holding off doesn't actually ring true.

She could agree to a family based arrangement but she would have to tell the CMS that you have agreed to reach agreement between yourselves.

For all enquiries about your Child Support Agency (CSA) case, you would need to contact them directly, https://www2.dwp.gov.uk/csa/v2/en/setup/apply-by-telephone.asp.

Just to let you know, the information that Nannyjane provided above is about the Child Maintenance Service, whereas you indicate that your case is with the CSA, so the information provided may not be relevant.
