Hi guys
I'm writing this post on behalf of a mate. She is a mother of her son and she her dad's father is very high profile in the UK.
He earns quite a bit of money for sure but when she applied for child maintenance the amount cane back as nil. He obviously leads a lavish lifestyle always on holiday new cars, mortgage with the new Mrs etc etc.
She knows that some of his income is classed as non taxable but she's finding it hard to understand how he can make thousands and it come back as nil? He also has a few businesses. Really baffled as she believes he is diverting income and not declaring all income earned. The child maintenance service said they can't touch non taxable income I e if he was given a lump sum from a deal of some kind.
Any help will be much appreciated as she and her son are really struggling but the red tape around this area is ridiculous!

Unfortunately it's very difficult to prove and there are a lot of people in the same situation. I believe there has been some recent news on this issue as to how the CMS are trying to crack down on these parents, but that's not going to help your friend at this point.
I know Gingerbread had a campaign earlier this year about non-paying parents, it might be worth her checking out if this is still going on.
I have the feeling that this may have changed with the CMS, but it's worth contacting them to check to see whether it's possible to apply for a variation on the basis of lifestyle inconsistent with income.
