Hi, when my ex and I separated last year we were living in my house in my name, I agreed to re-mortgage to help her and my kids, and I gifted her 90k to help buy her flat where she now lives, this is an additional £450 a month in mortgage payments.
We have 50/50 but she wants me to pay her money on-top of sharing every cost that I already do, if CMS get involved will they take my additional mortgage that I took out to help her/ my children when working out if I owe her any money?

This is only mortgage related expenses you can claim through CMS:
- making payments on a mortgage, loan or insurance policy for the home you and the receiving parent used to share – the receiving parent and the child or children must still live in the home and you must have no legal or ‘equitable’ interest in it
